Client privilege

The maintenance of confidentiality between an individual and professionals such as a doctor, solicitor, or clergy-man/woman ensures people feel safe confiding their darkest feelings and concerns. Confiding innermost fears and/or mistake would appear silly to the public yet we are only allowed to confess so many things to either a loved one or close friends. Thus, clients continue their ‘bad choices’ and ‘secrets’ whilst seeking guidance from professionals hoping that whatever they say may just work yet confidentiality forbids this from occurring unless the situation falls through the cracks… when a case of client privilege involves potential lives.

Should a patient say in their ‘consultations’ they are going to do so and so to an unsuspecting individual, a client confess all their involvement in an impendingterrorattack.

Is it really worthwhile to adhere to client confidentiality when lives are on the line. I believe there needs to be a degree of common sense and although there are moral implications behind breaking confidentiality, lives outweigh everything. So on exceptional cases when the immediate and direct threat to life appears, professionals should disclose what needs be the relevant information to authorities (although not punishing and making the perpetrator pay), so as to save the victims’. There’s always loopholes.

For too long this has occurred and public has no belief on this aspect of confidentiality.

Thus they don’t attend doctors or confide to the priest due to possible humiliation. Confidentiality must be adhered, not due to the ethical principles, but so that the profession continues and its individuals not afraid of any form of disclosure to authorities. Although it should remain the absolute minimum if at any point it involves harm or danger to another.

How would society exist without client privilege?

Many patients wouldn’t visit doctors nor clients go to lawyers. Confidentiality allows openness in communication.

This is where client privilege allows individuals to express ‘truthfully and honestly’.

This could either harm the patient or help the individual with greater benefit to not only himself but also to society. A world that relies on confidentiality as such may be a less happy society. Perhaps greater trust is also required. Client Privilege There is one single argument against client privilege – life.

We are often asked to sacrifice things we want for other things which others want more or need more from us.

However, there has to be a line of what is the more important sacrifice. Client privilege is not important to me except on moral grounds and for what the clients gain out of confiding in professionals who would usually betray what the patients had confessed.
