Near Mint Condition?

I recently found a Gyarados EX Full Art ultra rare card from the Pokémon XY BREAKPoint series. Near Mint condition versions of the card typically go for around $75 on the low end. I came across an auction on ebay that said it was "Near mint or better." The description stated it was kept in a penny sleeve inside a hard case since the day it was pulled from the pack.

I figured I'd take my chances since I could submit a return. I ended up winning it for $65. When it arrived I inspected it and found the condition wasn't as advertised.

It had a sizeable dent in the upper right corner.

It had an odd hook-shaped dent towards the center.

It also had quite a few scratches in the bottom right corner.

It was anything but "near mint condition," so I started a return on it and documented everything I found. I could've likely eliminated the dents, but the scratches looked a bit deeper than a simple polish could fix and the work really wasn't worth a $10 savings. It was a waste of my time, but at least I got my money back.
