Prenuptial Agreement- A Taboo or A Practical Necessity
This is the first time I have come across the term prenuptial agreement which is an indicator of the fact that its existence is not that common in my society, unlike the claim in Hl-featured contest.
I belong to a society where love marriages are not that common, instead the spouses are selected and finalised by the parents. In other words, arrange marriage is far more prevalent than love marriage.
Even in love marriages, the agreements about several aspects of the marriage like Haq Mehr, dowry, the execution of several traditions etc are discussed and settled by the parents of the two parties, and not by the spouses-to-be.
Moreover, divorce is something that is regarded by the society as one of the ugliest things existing on the face of the earth. People, in general, don’t want to consider it an option let alone be prepared for a time if it happens.
Marriage is indeed a sacred relationship, designed by God Himself. It serves several vital functions to the mankind. It is a method of providing a sanctuary to the new generation in the form of a family- the primary unit of the community life. It is a source to protect chastity of individuals along with providing emotional, physical and social comfort and support to the people involved in the relationship.
Nevertheless, life is quite unpredictable. The things we never expect may happen any time and turn our lives upside down. Marriage is no exception.
Sometimes, despite all the efforts of the individuals involved, marriage doesn’t seem to work the way it should. It doesn’t remain a source of comfort to the spouses rather becomes challenging to keep up with. I don’t think infidelity or being abusive are the only reasons for a relationship to go sour. There can be several other reasons that may make the love fade away and replace it with rather negative experiences.
If the question is whether love is not enough for someone to go into a marriage, my answer is “Love is enough for a marriage to work beautifully.” However, I don’t think love is enough for a marriage to end respectfully.
Ending the relationship happens to be ugly most of the time, including several accusations, disputes, and avoidance of responsibilities. I think the purpose of a prenuptial agreement is to ensure the well-being of the people involved providing a clarity about how the relationship is supposed to end gracefully.
Being a Muslim, I believe that Qur’an provides the best laws and guidelines about how a marital relationship should end. Here is video explaining them:

However, I have never seen these guidelines to be observed by the followers of Qur’an. Instead, the divorce brings a lot of disgrace, humiliation and financial challenges especially to the woman and her children.
It is because moral and ethical guidelines are easy to be undermined if they are not supported by a legal framework. Therefore, had I given the chance I would not mind making a prenuptial agreement. Nonetheless, I don’t think I have the enough courage to face the condemn that would be brought to be by the society by taking such a step.
How about you?
