Surprisingly, American Statutory-Rape Laws Can Work Both Ways

Yet another sensationalistic video has been posted on YouTube that complains about a 21-year-old man pretending to be 16 years old to get a 14-year-old girl's parents' approval for him to date their underage daughter. Quite frankly, I don't think that there's much of a difference between a 21-year-old man and a 16-year-old boy other than that one can legally drink alcohol and the other one can't, but that's just me. It's a measly five-year age difference. Here is the video below.

A 21-Year-Old Man And A 14-Year-Old Girl Engaged In Sexual Intercourse Five Times Under The Disguise Of A Same-Age Relationship

The young man was not truly a sexual predator. He never forced the 14-year-old girl to have sex with him, and she could have walked away from the relationship any time that she wanted to do so. She knew how old he was, and yet she passed him off to her parents as a 16-year-old boy so that they would allow her to date him. The young man's name is Justin Wallace, and the criminal justice system gave him the bum rap.

Did Mr. Wallace commit the major sex crime of the millennium by pretending to be 16 years of age so that he could date a 14-year-old girl without interference from the young girl's parents? Well, you'll be shocked to know that there have been cases of narcotics agents that pose as teenage minors in their line of duties and have gotten involved with high-school students on an intimate level. I watched a clip of such a scenario reiterated on the Geraldo daytime talk show from the 1990s.

I'm not claiming that these narcotics agents were in the right. I don't ever give any pity parties to law-enforcement officials for breaking the very same sex laws that they fight so hard to get elected officials to enact, whenever they get into trouble for doing so. However, I don't believe that Mr. Wallace should have been convicted of any sex crime.

1.  A Bird's-Eye View Of The Legalities Surrounding This Matter

Now, I could go into all the nitty-gritty about how Justin Wallace was in love with his 14-year-old girlfriend rather than looking to use her, but I think I should go ahead and address the elephant in the room here. Mr. Wallace's parents claimed that he had Asperger's Syndrome.

I have found that Asperger's Syndrome has been tied to numerous forms of fraud. Religious extremists are now claiming that autism is some kind of demonic possession. Of course, that's neither here nor there, and that's an entirely different article for another time.

What is obvious here is that Mr. Wallace is disabled on both a mental and intellectual level, and because of it, the 14-year-old girl could also have been charged with statutory rape or Lewd and Lascivious Battery as they call it in Florida. This case is quite similar to one that occurred in Maryland back in the 1990s.

If you read pages 510 through 541 of the online publication titled The Paradox of Statutory Rape by Russell Christopher and Kathryn Hope Christopher, you'll find that there is a law in Maryland in which a teenage minor can be charged with statutory rape for having sexual intercourse with a mentally disabled adult. A Myriad Of Legal Issues Surfaced After A 20-Year-Old Mentally Disabled Man Got A 13-Year-Old Girl Pregnant

The name of the 13-year-old girl that the 20-year-old mentally disabled Maryland man had sex with was Erica Frazier, and his name was Raymond Garnett. Ms. Frazier lied about her age, and she kept egging this young man on to have sex with her.

The Maryland authorities could have charged Ms. Frazier with a sex crime for knowingly having sexual relations with a mentally disabled man, even though she was below the statutory age of consent in Maryland and he was an adult. Of course, the police weren't going to take this same matter down that same road, because it would not have been good for optics.

Florida where Mr. Wallace's situation took place has an analogous such animal in its sex laws. The pertinent statutory code is 794.011. Then again, the Flagler County police were not going to arrest the 14-year-old girl that Mr. Wallace had sex with five times for having sexual intercourse with a mentally disabled adult man, because it might reflect negatively on their public image, so to speak. Oh, brother.

Similarly to Mr. Wallace, Mr. Garnett was unable to get acquitted of the criminal charges against him or get his conviction overturned by using his mental and intellectual disability as a defense. Fortunately, the judge in his matter was protective of him and kept him out of prison upon knowing that he was an easy target for bullying.

In my humble opinion, Mr. Wallace's only real crime was falling in love. Just because he didn't want to share his love life with the police, it doesn't mean that he was aware of their ploy to get him to incriminate himself in one way or another.

The police knew that Mr. Wallace was vulnerable to their tactics, and they manipulated him in that regard. If Mr. Wallace had understood what was going on after they arrested him, he would have asked for a lawyer immediately. The simple fact alone that the police didn't give Mr. Wallace enough time and leeway to have a lawyer present with him when they questioned him shows that they violated his Fifth-Amendment rights.

Of course, the YouTube influencer who posted the video above about Mr. Wallace and goes by the user name of "Caught In The Act" is one of those bozos who believe that all cops can do no wrong and that the Puritanical Establishment is always right. That YouTube influencer couldn't care less about any of the nuances with the case, because he only wishes to absorb his audience into his make-believe world of age-appropriate perfection and wholesome purity.

The United States is progressively evolving into a Fascist totalitarian police state, and there are actually people that want this sort of thing to happen to our country. I have nothing against the Republican Party. In fact, I find many of their ideologies to be interesting. However, if too many right-wing nuts get into office, the police are going to take it as a free pass to abuse their power and authority everywhere in our nation.

Furthermore, if Mr. Wallace has to register as a sex offender, it's not going to serve the greater good. In that respect, the sex-offender registry is merely another cash cow that causes more harm than good to society. Ahmad Jamal Blakemore explains this fact in his video below.

2.  Simply Another Case Of Police Misconduct And Abuse Of Police Authority

There can be no question that the Flagler County police were never Justin Wallace's friends, even though they kept running their mouths about how they wanted to help him. Right. They wanted to help lock him up for whatever they could book him with, real or imagined. A lawyer should have been present to protect Mr. Wallace's rights when the police questioned him. These police officers were like wolves in sheep's clothing.

Okay. So Mr. Wallace was 21 years old when he was arrested, and the girl he had sex with five different times was 14 years old. In many European nations, their sexual relationship would have been perfectly legal.

Considering that the United States has become the deadbeat teenage dad capital of the world, I feel that our nation has lost its moral high ground to treat men like Mr. Wallace as sex criminals. The semi-illiterate hotheads that would accuse Mr. Wallace of being a child molester for having sexual intercourse with his 14-year-old girlfriend are the very same hypocrites that would slut-shame her if a 15-year-old boy got her pregnant and then bailed on her.

Mr. Wallace had to serve time behind bars for doing something completely harmless with a teenage girl. Meanwhile, a 15-year-old deadbeat father who knocked up a 13- or 14-year-old girl would get to move on with his life inasmuch as he was lucky enough to be on the same side of the legal age line as the underage girl he got pregnant. How does that make any sense?

The 14-year-old girl reported that her first sexual contact with Mr. Wallace was not mutually desired. However, I question her candor or rather lack thereof, because conventional wisdom holds that she would not have had sexual intercourse with him four additional times if her statement were true.

I honestly believe Mr. Wallace's side of the story more than I believe the 14-year-old girl's side of the story, because it doesn't seem that he would have the mental capacity to tell a lie. On the other hand, teenage girls lie all the time to their parents and to others.

Locking Mr. Wallace up behind bars definitely puts him into danger, whereas the 14-year-old girl was never in danger while she was involved with this young man. This case definitely would have warranted jury nullification.

As I read over the posts in the comments section to the video above of Mr. Wallace's arrest and interrogation, I found that way too many people there have Pedophile-Panic Derangement Disorder, for a lack of a psychiatric term for it. What makes it so outrageous is that a 21-year-old man who is sexually attracted to a 14-year-old girl isn't even a pedophile by clinical definition.

Female teenage minors are not still watching Bugs Bunny cartoons, and they're definitely not still playing with crayons and coloring books. Most of them make themselves up to look equally as appealing to adult men as they do to boys their own age. The police charged Mr. Wallace with Lewd And Lascivious Battery Of A 14-Year-Old Girl, whereas they could have charged his 14-year-old girlfriend with Lewd And Lascivious Battery Of A Mentally And Intellectually Disabled Man under the available Florida sex crimes statutes. The judge should have dismissed his case altogether on the grounds that he was obviously unfit to stand trial. He definitely didn't have the mental and intellectual capacity to comply with the terms and conditions of his probation.

Mr. Wallace's entire criminal case was a gross miscarriage of justice. The police never treated him fairly, and he was never granted a fair trial, period.

3.  Final Thoughts And Food For Thought

Whenever hotheaded social justice warriors and YouTube influencers like YouTuber Caught In The Act and even police officers post videos like the one embedded at the beginning of this article everywhere on the Internet, keep in mind that a number of people are watching it. It's not only these semi-illiterate imbeciles from the TCAP ("To Catch A Predator") community that are watching it, but also individuals like me that will have much to say about these videos.

When people like me decide to call these police officers out on their shady investigative tactics and their waste of taxpayer dollars, elected officials are going to get voted out of office eventually for supporting these acts of tyranny from our so-called criminal justice system. Once that happens, American laws are eventually going to be changed to stop police officers from abusing their power and authority in this manner.

Also, more and more frivolous and malicious statutory-rape trials will be acquitted on jury nullification in that event. It outrages me how police officers will argue that the law is the law whenever they prey on someone like Justin Wallace or Raymond Garnett; but then they will turn around and cherry-pick which laws they want to enforce and which ones they prefer to ignore. If you're an officer of the law, you don't get to do that; and I can be rest assured that there are probably many of you men and women in blue that read my articles.

I realize that there are going to be people here on the Internet that are going to seek to censor and even silence individuals like me who believe in free speech. However, keep in mind that even if those people are successful at doing so, we'll find some way to get our voices heard elsewhere on the Internet. Nobody has absolute control over the entire Internet. Cyberspace is a vast world of its own.

What it comes down to is that here in the United States, "statutory rape" should not be a strict-liability offense but rather an intent offense that requires proof that the alleged victim was actually harmed. Perhaps these laws in their present forms were in sync with the standards of the 1950s, but today they have become dangerously archaic in nature. Teenage sex was not a thing in the 1950s as it is now.
